Draft. These terms are written in plain language and are being reviewed by a lawyer before Presto opens to everyone. We will change this page, and tell teachers and tutors who have set up a teaching space, if the final wording differs in a way that matters.
These terms apply when you use Presto Math with students you teach or tutor, through a teaching space (an "organisation") created from the Teacher area at app.prestomath.com. They sit alongside our Terms of Use and Privacy Policy. Where they differ for a teaching space, these terms apply to it. Presto is run by Allan Thöle, an individual trading as Presto Math ("we", "us"). "You" is the school or tutor, and the teacher who creates the teaching space for them.
1. Who can set up a teaching space
- Access is by invitation while Presto is invite-only: you need a teacher code from us.
- If you teach at a school, you confirm you have the school's authority to use Presto with its students. If you are an independent tutor, you confirm you act for your own tutoring business and will use Presto only with students you tutor.
- You must be an adult. You are responsible for the teachers you add to your organisation (up to 10 while access is limited) and for what they do in it.
- Limits while we are testing: up to 12 classes per organisation, 35 students per class and 300 students in all. We may change these, and will tell you first if we lower them.
2. Roles: who decides what
For the information about your students that you put into Presto or that is created when they practise, you (the school or tutor) decide why and how it is used, and we process it for you and for no other purpose. We act on your instructions given through the Teacher area and these terms. For the information we hold about you as a teacher (your email address and sign-in), we are responsible, as set out in our Privacy Policy.
3. Student information we process
- What you give us: a first name or nickname for each student, and the class they are in. We do not ask for surnames, email addresses, dates of birth, photos or contact details of students, and you must not enter them in the name field.
- What we create: a class code, a login name and a 4-digit PIN for each student (the PIN is stored only as a one-way hash, and is shown to you once); and the student's practice results: runs, scores, times, levels, medals, streak and weak spots.
- What you can see: a summary of each student in your classes (streak, golds, minutes today and this week, last active, weak spots) and, when you open a student, their most recent runs. Each time a teacher opens a student's detail we keep an audit record of who looked and when.
- What you cannot see: a student's PIN after it has been shown, or anything a student's family keeps in a separate family account.
4. What we do and do not do with it
- We use student information only to run Presto for your students: to let them sign in, practise and see their progress, and to show you their summaries. We may also use anonymous, combined statistics that cannot identify a student to improve Presto.
- We do not sell it, share it for advertising, show advertising to students, or use it to build advertising profiles. Presto's student screens contain no third-party advertising.
- We do not contact students. We do not send them email, because they do not have an email address with us.
- We keep it secure: access to it is limited by rules that give each teacher access only to students in their own classes; sign-in attempts are rate limited and PINs lock after repeated wrong guesses; and data is encrypted in transit.
5. Your responsibilities
- You have a lawful basis to use Presto with your students, and you give them, and where the law requires, their parents or guardians, the notices and obtain the consents the law requires. Schools usually do this under their own policies. Tutors must make sure a parent or guardian has agreed to the student using Presto, in particular for children under 13 (under 16 in some places) and where the law of your country requires parental consent.
- Give students only their own login and keep printed login sheets safe.
- Use Presto only for teaching and tutoring. Do not use the Teacher area to collect other information about students.
- Tell us promptly at support@prestomath.com if you believe a login has been misused.
6. Parents and guardians
A student's parent or guardian can ask you, or us, to show, correct or delete their child's information. If we receive such a request we will pass it to you, and help you to answer it. When you take a student out of a class, the student's progress is kept for 90 days so that a parent can claim it into a family account; if it is not claimed in that time, we delete it.
7. How long we keep it, and deleting it
- While a student is in a class, we keep their information so they can carry on practising.
- When you take a student out of a class, or end your organisation, we keep their progress for 90 days (so a parent can claim it) and then delete it.
- You can ask us at any time to delete a student, a class or your whole organisation, by email from your teacher address. We will delete it, including the copies in our backups within a reasonable time, unless the law requires us to keep something.
8. Where it is processed, and who helps us
Student information is stored in Google Cloud (Firebase) in Sydney, Australia. We use Google's services to run Presto: Firebase Hosting, Authentication, Firestore and Cloud Functions, and Google reCAPTCHA to stop automated abuse of the sign-in pages. We use a mail service to email teachers, and none of these services are given the names of students for any purpose other than running Presto. We will tell you before we add another service that handles student information, and you may end your use of Presto if you object.
9. If something goes wrong
If we find out that student information has been accessed or lost in a way that is likely to harm students, we will tell the owner of the organisation without undue delay, with what we know, and will help you to meet your own obligations to notify.
10. While Presto is being tested
Presto is invite-only and still being finished, so features may change or stop working. Presto is free during its launch period and will become a subscription app; we will give notice of the price and of what stays free before anything is charged, and nothing is charged to a teaching space without your agreement. Both sides may end the arrangement at any time: you by deleting your organisation, we by giving you notice, and we will first give you the chance to export or print your students' summaries.
11. Responsibility
We provide Presto with reasonable care and skill. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you for anything connected with a teaching space is limited to what you have paid us in the 12 months before the claim (which may be nothing while Presto is free). Nothing here limits rights that cannot lawfully be limited, including under New Zealand's consumer and privacy laws and the mandatory laws where your students live.
12. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction. If you or your students live elsewhere, this doesn't take away any protection that the mandatory law of your own country gives you.
